As a member of Ergatta’s US Refer-a-Friend Program (a “Referrer”), you are subject to Ergatta’s Terms of Use and Ergatta’s Privacy Policy as well as to the additional terms set forth in these Refer-A-Friend Program Terms (the “Referral Terms”). Please note that, unless we define a term in these US Referral Terms, all capitalized terms used herein have the same meanings as in our Terms of Use. By submitting a Referral or using an Ergatta Referral link, you agree to be bound by the Referral Terms.
Definitions:
Active User. Any individual who holds an Ergatta user account and has an active paid subscription to the Ergatta app, and is otherwise eligible to use Ergatta’s Services, when a Referral is made.
Referrer. Any individual who is otherwise eligible to participate may become a member of Ergatta’s Refer-a-Friend Program by being an “Active User”.
Referred Customer. A person in the United States who arrives to the Ergatta website or any of its subdomains (collectively, the “Site”) by using the unique Refer-a-Friend Site link provided by a Referrer, and is otherwise eligible to use Ergatta’s Services. The Referred Customer and the Referrer cannot be the same person, as determined at Ergatta’s sole discretion.
Qualified Referral. A Qualified Referral is defined as a bona fide first-time purchase of products made via ergatta.com by a Referred Customer. A qualified purchase includes either (a) The Ergatta Rower and must have a total value of at least US$1,949 (excluding taxes, discounts, shipping charges, returns, canceled transactions, and any applicable third-party fees) (a "Rower Qualified Referral"), or (b) the WaterRower Upgrade Package and must have a total value of at least US$474 (excluding taxes, discounts, shipping charges, returns, canceled transactions, and any applicable third-party fees) (a "Rower Upgrade Referral") and must be purchased by an individual located in the US for shipping to an address located in the US. Purchase of only apparel or accessories without purchasing The Ergatta Rower or WaterRower Upgrade Package does not qualify as a "Qualified Referral." A Qualified Referral becomes eligible for a Referral Reward within 7 days after purchase, provided that the purchase is not canceled or returned.
Referral Reward. Subject to the limitations set forth herein, Referrer shall receive a reward in the form of value determined by Ergatta for a Qualified Referral (a “Referral Reward”). A Referrer may only earn one Rower Qualified Referral or one Upgrade Qualified Referral (but not both) for each Referred Customer, up to a maximum of US$600 in Referral Rewards value per calendar year, unless otherwise allowed by Ergatta in its sole discretion. Referral Rewards may vary. The specific Referral Reward offered is in the offer associated with Referrer’s unique Refer-a-Friend link. The Ergatta Rower and WaterRower Upgrade Package each have their own unique Refer-a-Friend link and, therefore, different Referral Rewards.
How It Works:
As a Referrer, click on the “Refer a Friend” link post-checkout on your order tracking page, within select emails, at ergatta.com/pages/refer or at ergatta.com/pages/refer-upgrade. After selecting the “Refer a Friend” link, enter your name, and email, and follow the prompted instructions to share a unique Refer-a-Friend Site link through email, social media (either by Tweet or a direct message on Facebook), SMS, or by copying the link and sharing directly with friends and family.
When a Referred Customer uses your unique Refer-a-Friend Site link to make a purchase that qualifies as a Qualified Referral:
The Referred Customer will receive an offer associated with your unique Refer-a-Friend Site link. Offers may vary based on the Referred Customer’s coupon code; and
The Referrer will receive a Referral Reward. A link to redeem the Referral Reward will be sent to the Referrer within fourteen (14) days following a purchase made by a Qualified Referral, provided that the purchase is not canceled or returned. Referral Rewards may only be redeemed for purchases made in United States Dollars. As a Referrer, you are responsible for any tax liability and shipping costs resulting from Referral Rewards.
Limitations. The Referrer’s unique referral link may not be shared, sold, or used in any way except by the Referrer to obtain Qualified Referrals; referral links shared to or obtained through other sources (such as through a posting to a third-party intermediary or website by someone other than the Referrer) will not be honored. Each Referrer is eligible for only one (1) Referral Reward per each Qualified Referral. If the Referred Customer cancels their purchase or returns the product, you will no longer be eligible for a Referral Reward. Multiple cancellations or returns are grounds for exclusion from the Refer-a-Friend Program.
Eligibility. Ergatta’s Refer-a-Friend Program cannot be used by businesses or individuals for affiliate lead generation or posted on discount sites. For businesses or group discounts, please contact info@ergatta.com.
No Combination. The Refer-a-Friend Program may not be combined with any other offers, discounts, or promotions from Ergatta or be used for final sale products.
Compliance with Applicable Law. As a Referrer, you agree to comply with all applicable law, including, but not limited to the CAN SPAM Act and Telephone Consumer Protection Act. Any distribution of your Refer-a-Friend Program link that could constitute unsolicited commercial email, text message, or "spam" under any applicable law or regulation is expressly prohibited and will be grounds for immediate termination of your Account and exclusion from Ergatta’s Refer-a-Friend Program.
Right to Terminate Accounts. Ergatta reserves the right to terminate the Account of any Referrer and/or Referred Customer at any time and without notice, including, but not limited to, if we, at our sole discretion, consider any Referrer and/or Referred Customer’s conduct to be in violation of these US Refer-A-Program Terms.
Right to Cancel Program or Change Terms. Ergatta reserves the right to cancel the Refer-a-Friend Program and to revise these Refer-A-Friend Program Terms from time to time. If we make any material changes to these Refer-A-Friend Program Terms, we’ll notify you of those changes by posting them on the Services. If the Refer-A-Friend Program is terminated, any unclaimed Referral Rewards will be forfeited at that time.
